State Specific Tax Amnesty Programs
Some states never offer these types of programs, but most do at one time or another. Some are advertised, some are not. For states without state income tax (Alaska, New Hampshire, Tennessee, Florida, South Dakota, Washington, Nevada, Texas, Wyoming), sales and property tax payments sometimes are allowed through these types of programs. Below is a handful of the largest states and their tax amnesty allowances and history over the years.
California
Two programs have run in the recent past by the official California state tax collection group called The Franchise Tax Board. One program targeted those who had engaged in tax shelter practices (usually in the form of multiple LLCs) to evaded or reduced state taxes illegally. California put out a call a VCI or Voluntary Compliance Initiative, which is similar to tax amnesty. This VCI ran from January 1 to April 15, 2004 with amended and first time returns from 1990 to 2002.
The second program was to reach out to taxpayers who were no longer in the system and who owned money to the state. This true tax amnesty program ran from Feb. 1, 2005 to March 31, 2005. With both efforts combined, this resulted in recovering 4.8 billion dollars, with 1.5 billion in new money revenue.
New York State
New York State has had four tax amnesty program periods, the latest running from Oct. 1st, 2005 to March 1st, 2006 for income tax as well as corporate. The previous program before last year ran from Nov. 18th, 2002 to Jan. 31st, 2003 and was for all types of taxes including property and sales. Three hundred and forty nine million was raised in the ’02-03 period and five hundred eighty-two point seven million was raised in the latest New York state tax amnesty program.
Texas
Since Texas does not require a state tax, only prosecution from unpaid sales and property tax were affected. The last three that were announced happened in 1 -3 month periods in the years 1984, 2004, with the last one ending in August 2007 and did not receive state legislative authorization.
The purpose of this is to show that there have been opportunities over the years, and even without tax amnesty, there are many other avenues of IRS help, whether you need tax help in New York, Texas, California, or any other state. There are other tax relief options.
